| On Monday, March 26, 2007, Robert and Sarah Gordon filed a class action lawsuit against OnStar Corporation and General Motors Corporation on behalf of OnStar subscribers, owners and lessees whose OnStar services are being terminated because their vehicles have analog OnStar equipment. The Gordons are represented by Pennsylvania lawfirms Smolow & Landis, Edelson & Associates, LLC, and Spector, Roseman & Kodroff, P.C.
The Gordon's class action complaint alleges that OnStar is a unique in-vehicle safety system that provides automatic crash notification to emergency responders, stolen vehicle location, remote door unlock and remote diagnostics in the event of problems with airbags, anti-lock brakes or other systems. The complaint further alleges that GM and OnStar touted the life-saving benefits of OnStar and that like other vehicle safety systems, it would function for the life of the vehicle and would be transferable to subsequent owners.
Although GM has promised that it would not leave its OnStar subscribers in the lurch, OnStar has notified subscribers with analog equipment that due to design limitations, their OnStar service will terminate on December 31, 2007 and that OnStar and GM will not provide repairs or upgrades. Subscribers are being told that if they want to continue to receive OnStar service, they have to purchase or lease a new or used GM vehicle with digital equipment.
In their lawsuit, the Gordons are asking the court to certify a nationwide class of OnStar subscribers, owners, and lessees, and for the court to award damages and for injunctive relief to order OnStar and GM to provide repairs, upgrades or other means of obtaining OnStar service.
If the case is certified by the court as a class, class members will receive notice of the court's action.

On August 17, 2007, the United States Judicial Panel on Multidistrict Litigation transferred this matter to the U.S. District Court for the Eastern District of Michigan for consolidation.
